The Peach Club Fitness Challenge Terms and Conditions

 

By entering and participating in The Peach Club (TPC) Fitness Challenge (the "Challenge"), you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully before participating. If you do not agree with these terms, you should not enter the Challenge.

 

1. Challenge Duration


The Challenge will take place from May 12, 2025 to May 25th, 2025 (the "Challenge Period"). Entries will only be accepted during this period.

2. How to Enter


To participate in the Challenge, you must:

  1. Complete all 10 TPC classes during the Challenge Period. These classes can be accessed through The Peach Club’s platform (TPC).

  2. Post your completed classes to your Instagram story as you go. You must tag @thepeachclub on each post for verification purposes.

Entries will be deemed valid if you:

  • Complete all 10 classes,
  • Post each completed class to your Instagram story with @thepeachclub tagged, and
  • Adhere to the eligibility and other requirements of these Terms and Conditions.

Failure to comply with the posting and tagging requirements will disqualify your entry from the prize draw. No Purchase Necessary - If you do not have a TPC membership you can enter using the steps listed below.

 

3. No Purchase Necessary


No purchase is necessary to enter or win any TPC Challenge. If you do not have an active membership with The Peach Club, you may still enter by sending a self-addressed postcard to the following address:
58-6127 Eagle Ridge Crescent, Whistler, BC, V8E0W7, Canada.
TPC assumes no responsibility for delay, damage or any issue with delivery of mail sent to this address. Participants entering through this method will have the same eligibility as those with an active membership. 

 

4. Prizes


There will be four (4) grand prizes awarded in the Challenge, each consisting of CAD $2,000 (two thousand Canadian Dollars). The prizes are non-transferable and non-exchangeable for any other prize or cash equivalent.

The winners will be selected randomly from all eligible participants who successfully complete the Challenge (i.e., by completing all 10 TPC classes and posting them to Instagram as outlined above).

5. Selection of Winners


The winners will be selected at random after the Challenge ends on May 25th. The selection process will occur no later than June 5th, 2025. Odds of winning depend on the number of eligible participants.

Winners will be notified via direct message on Instagram or by email (if contact details have been provided) no later than June 5th, 2025. If a winner does not respond within 48 hours of notification, a new winner may be selected at TPC's discretion.

6. Payment of Prizes


Prizes will be paid to the winners via a payment method chosen by The Peach Club. The winners will be contacted and asked to provide their payment details (e.g., bank account or PayPal) within 7 days of the notification. Winners must provide accurate and complete payment information.

TPC is not responsible for any delays or issues with prize payments due to incorrect or incomplete contact or payment details provided by the winner.

Winners will receive their prizes within four weeks of the Challenge's completion and verification of their eligibility.

7. Limitation of Liability


By participating in the Challenge, you agree to release, indemnify, and hold harmless The Peach Club, its affiliates, and their respective employees, officers, directors, agents, and representatives from any and all claims, actions, damages, liabilities, and expenses arising out of or related to participation in the Challenge or acceptance and use of the prize.

TPC assumes no responsibility or liability for:

(a) any incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions;
(b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Challenge;
(c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, cameras, computers, or providers utilized in any aspect of the operation of the Challenge;
(d) inaccessibility or unavailability of any network or wireless service, the Internet, or website or any combination thereof;
(e) suspended or discontinued Internet, wireless, or landline phone service; or
(f) any injury or damage to a participant’s or any other person’s computer or mobile device which may be related to or resulting from any attempt to participate in the Challenge or download of any materials in the Challenge.

If, for any reason, the Challenge is not capable of running as planned due to factors that may include, but are not limited to, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Challenge, TPC reserves the right at its sole discretion to cancel, terminate, modify, or suspend the Challenge in whole or in part. In such event, TPC shall immediately suspend all prize drawings and awards, and TPC reserves the right to award any remaining prizes (up to the total ARV as set forth in these Official Rules) in a manner deemed fair and equitable by TPC. TPC and Released Parties shall not have any further liability to any participant in connection with the Challenge.

8. Publicity and Promotion
By entering the Challenge, participants consent to the use of their name, Instagram handle, and any content they post to social media in connection with the Challenge (including photos, videos, and Instagram stories) for promotional purposes by TPC, without further compensation or permission, except where prohibited by law.

9. General Terms

  • Compliance: All participants must comply with the Challenge requirements, as well as Instagram’s terms of service and community guidelines.
  • Privacy: Participants’ personal information will be used solely for the purposes of administering this Challenge and for contacting winners. TPC will not sell or rent participants’ personal information to third parties.
  • Modification: TPC reserves the right to modify or cancel the Challenge at any time for any reason, including in the event of fraud, technical failures, or any other cause that disrupts the integrity of the Challenge.
  • Disqualification: Any individual who violates the Terms and Conditions or engages in any fraudulent activity, including providing false or misleading information, will be disqualified from the Challenge.

10. Force Majeure
TPC shall not be held responsible for any delay or failure in the performance of its obligations under these Terms and Conditions if the delay or failure is due to circumstances beyond its reasonable control, including but not limited to natural disasters, strikes, or other unforeseen events.

11. Dispute Resolution
In the event of any dispute arising out of or in connection with these Terms and Conditions or the Challenge, the dispute shall be resolved through binding arbitration in accordance with the laws of British Columbia, Canada. Any arbitration proceedings will take place in Whistler, British Columbia.

12. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the province of British Columbia, Canada.

13. Eligibility
The Challenge is open to individuals worldwide, provided they are at least 18 years of age at the time of entry. Employees, contractors, agents, and affiliates of The Peach Club ("TPC") and their immediate family members are not eligible to participate.

Participants who do not have an active membership with The Peach Club can still enter the Challenge by sending a self-addressed postcard to the following address:

Participants entering through this method will have the same eligibility as those with an active membership. TPC is not liable for any issues with shipping delays or loss of shipment.
